RANDOM — Privacy Policy

Effective as of April 11, 2018

This is the Privacy Policy ("Policy") for "RANDOM" mobile application and related services (the "App"), provided to you ("you", "Customer") by Pavlo Danyliuk, a Ukraine-registered individual entrepreneur (local: ФОП Данилюк Павло Сергійович, taxpayer ID 3383016691) operating under the name "Paul Danyliuk" and online alias "Actinarium" ("we", the "Developer").

This Policy constitutes a reasonable effort to inform you about how your data is handled while using the App. You should acknowledge this and must not take legal advantage of any possible incompleteness or ambiguity in this Policy. In case you encounter such incompleteness or ambiguity that affects how you perceive the provision of the App and related services to you, you must either request clarification from the Developer by email and abstain from using the App before receiving the reply and re-evaluating the Policy accordingly, or cease using the App immediately. If you disagree with any part of this Policy, you may not use the App.

The Developer may, at any time and for any reason, amend the Policy by publishing an amended version at this Web URL, or linking to the amended version from this Web URL. The amended Policy shall automatically be effective upon publishing, and generally it is the Customer's responsibility to check for the updates. In case the amended version contains changes that are, in our sole discretion, are material and may greatly affect your use of the App and/or the way your data is handled, the Developer will make their best effort to notify you of such changes by displaying an appropriate message in the visual interface of the App.

Overview

  • We do not collect any personally identifiable information ("PII") from you upon your normal use of the app.
  • In later versions, it will be possible to sign into the App. This will be optional, and rejecting to do so won't prevent you from using the App. In case you choose to sign in, such PII as your name, email and profile picture will be disclosed to the Developer. You will be prompted to review the Privacy Policy before you sign in for the first time.
  • The App uses industry standard analytics and crash reporting services provided by 3rd parties. Operation of those services is governed by their respective Terms of Service and Privacy Policies. Those services do not collect your PII, however they make it possible to recognize the same device over time.
  • The App uses Google APIs, Google Play Services, and Firebase platform (operated by Google LLC), in full compliance with their respective Terms of Service and Privacy Policies.
  • This non-identifiable information is collected upon your use of the App:
    • Your system-wide Advertising ID, unless you opt out of receiving interest-based ads in the system-wide settings. It is used to serve you better ads.
    • Your country and city, demographic and interest data (associated with your Advertising ID). The Developer will not have access to this data about a particular user, but will be provided with aggregated results on the whole audience.
    • Your device model, Android version, system language, network operator, and application logs in case of a crash. These are used to better understand the audience and troubleshoot specific problems.
    • Actions you perform in the App, and some content that you enter into the app, such as number ranges and list titles. This is collected solely with the purpose to better understand how the App is used and improve the experience.
      Please note: when you create, edit, or use a list in List generator, its title is reported to the Developer. Neither the contents of the list nor generator results are reported. We need this to better understand what kind of custom lists users need the most, and improve the experience. If you wish to keep a list title private, simply don't set it, and the App will display an automatic title while keeping it anonymized for analytics.
  • The App does not collect any PII from children under the age of 13.
  • To comply with GDPR, on or before May 25, 2018 the app will explicitly ask for your consent to serve you personalized ads.

Details

As of April 9, 2018, the App is a standalone application, whose all functionality is accessible directly on the Customer's physical or virtual device and doesn't require any authentication or data exchange with other devices to function properly. If connected to the network, however, the App will make attempts to load the ads from 3rd party ad networks and report user behavior within the app to the 3rd party analytics services. Below are the details of how such activities are carried out.

Use of the App includes the use of 3rd party services, possibly including but not limited to: the Android platform and Google Play Services, governed by their respective Terms of Service and Privacy Policy; a web browser with its Terms of Service and Privacy Policy; your mobile device manufacturer and their Terms etc. These services may have their own terms on how they collect and handle your data. Your use of the App implies that you have previously agreed with the terms for the technologies that you use to access the App.

The Service uses 3rd party analytics and crash reporting tools, namely Firebase Analytics and Crashlytics (both operated by Google LLC). These tools are used by the Developer to collect anonymized, non-identifying data on how the Service is used and whether the Customers may experience any issues with using the Service. The examples of data collected and accessible by the Developer are: screens of the mobile application navigated, settings changed, errors reported and application crashes occurred, events performed, such as using generators and managing lists. Each of these reported events may also include information on the purchases made by the user, WITHOUT possibility to link this data to a specific Customer unless the Customer signs in to the App. This data is collected by Developer with the sole purpose to better understand usage patterns and feature discovery, quickly react to issues, and ultimately improve the App. The Developer can also see aggregated data on users' location (country and city level), demographics and interests. Additionally to this, the aforementioned platforms may collect additional data without the Developer being aware or able to access those data — for details on how that data is collected and handled please consult with the respective Terms and Policies of the aforementioned tools. Such data collection is a standard practice, and most of the applications on your device also implement it, often to a much greater extent.

To make revenue, the App serves sponsored ads. As of April 9, 2018, the ads are served in a single placement on the App's main screen and are provided by MoPub (operated by MoPub, Inc., a wholly owned subsidiary of Twitter, Inc.). The next paragraph is effective when sign in functionality is available:
To sign in, the Customer must create a User Account by either providing their email and password, or signing in with their Google account. The authentication is managed by Firebase according to its Terms of Service and Privacy Policy linked above. The Developer may see limited User Account data, namely the email, date of User Account creation and last sign in, the means of signing in, and unique identifier that allows the Developer to identify this Customer's User Data. The Developer cannot use Customer's credentials to impersonate the Customer, namely, the Developer doesn't have access to the Customer's password or other sensitive data that would allow the Developer to authenticate as the Customer on any 3rd party resource. The Developer will never use the Customer's email to send or facilitate sending information other than directly related to the use of the Service.

The Developer has implemented reasonable security measures in order to protect both personal and non-personal information from loss, misuse and unauthorized access, disclosure, alteration or destruction. This said, the Developer is not to be held responsible for any damage, loss, or injury in case there's an incident of hacking, tampering, or other unauthorized access or use of the App or User Accounts.
